  Become a sympathetic employer       

What is a "sympathetic employer?"

 

A sympathetic employer understands the plight of the non-custodial parent. Attacked from all sides by politicians, lawyers, judges, the media and governmental agencies - a sympathetic employer is willing to give work to non-custodial parents without reporting this to the government.

 

Best Method - Company to Company

Instead of hiring a non-custodial parent as an employee, contract your work out to their own company. This is completely legal, commonplace and has many advantages including:

      No tax liability

      No Social Security contribution required

      No unemployment insurance required

      No workman's compensation liability

      No lawsuit liability (sexual harassment,

      No overtime liability

      No time accounting overhead

      No paid benefits liability

      No special government reporting required

Second-best Method - Independent Contractor

When hiring an Independent Contractor (IC), you only report their income after the end of the year. IRS form 1099 is issued to either the contractor or their company. There are disadvantages to the company contracting out to IC's including:

      The company is liable for unpaid IC taxes

      A 1099-MISC (Misc. Income) form is issued each year and requires an SSN or EIN (if you move each year, that's fine. See also "Need a New SSN?")

Finally - Work on a cash-only Basis

If you pay the "virtual employee" less than $600, you do not (legally) need to report this income. If you hire this virtual employee with different names and different SSN's and they're all under $600 each, then too you need not issue the IRS a 1099-MISC. It's much easier to pay the non-custodial parent cash and not keep any records of their name, dates worked or amounts paid.

The last two are not legal - "but what the hell?" they've already convinced the public that non-custodial parents are criminals. If you're going to take the blame for being a criminal, you might as well reap the benefits criminals enjoy.
